PRELIMINARY PROVISIONS
The website www.eveilleurparfums.com (hereinafter referred to as "website" or "web shop") is owned by the company La Libellule d.o.o., Petra Zoranića 23, Metković, Republic of Croatia, OIB: 15644829398, MBS: 090043216, registered in the court register at the Commercial Court in Dubrovnik, VAT ID: HR15644829398, represented by the director Dajana Jukić (hereinafter referred to as "La Libellule d.o.o.", "we", "us" or "Seller").
These Terms and Conditions of Sale define the procedure for ordering, payment, delivery, and return of products offered on our web shop, as well as the rights and obligations of the parties arising from the purchase of our products. These Terms and Conditions of Sale are an integral part of every purchase contract concluded through this web shop.
This web shop is hosted on the online e-commerce platform Shopify, owned by Shopify International Limited, Ireland, D04 XN32, Dublin 4, Haddington Road, 1-2 Victoria Buildings, 2nd Floor, through which we sell our products.
The customer of our products can be any adult, legally capable natural person, or legal entity.
By ordering products from our website, you acknowledge that you have read, understood, and agree to these Terms and Conditions of Sale and our Privacy Policy. Therefore, we encourage you to read these documents carefully. Should you have any questions or need further clarification, please do not hesitate to contact us using the information provided below.
The Seller reserves the right to update these Terms and Conditions of Sale from time to time. Each time a customer makes a purchase from this web shop, the Terms and Conditions of Sale that were in effect at the time of the purchase will apply. Therefore, we invite you to check the Terms and Conditions of Sale each time you order our products so that you are aware of the terms that govern your purchase.
These Terms and Conditions of Sale are provided in both Croatian and English for the convenience of our customers. In the event of any discrepancies or conflicts between the two versions, the Croatian version shall prevail and be considered legally binding.
PROCEDURE FOR PURCHASING PRODUCTS
Once you have selected all the products you wish to purchase, these products will be added to your cart. The next step is processing the order and making the payment. To do this, you need to follow the steps of the purchasing process and provide or confirm the information requested in each step.
Before placing an order, you can correct any mistakes you have made at any time, change the contents of the cart by adding or removing one or more products from the cart, or cancel the entire order during the payment process before submitting the order. You will also have the opportunity to review and edit all the details of your order, including billing and shipping information.
After you place an order on our website, we will send you an email to confirm that we have received it. However, your order only represents an offer to buy products and it might not be accepted due to reasons such as product unavailability, pricing errors, or declined payment (i.e., non-authorization of payment). If we are unable to fulfill your order, we will contact you via email or phone to inform you. We are not obligated to sell you a product at an incorrectly listed price if the pricing error is obvious and unmistakable, and you could have reasonably understood that the price was incorrect. If we are unable to complete your order for any reason, we will fully refund any amounts you have already paid.
We will confirm our acceptance of your order by sending an email that confirms the products have been dispatched ("Shipping Confirmation"). A legally binding sales contract between you and us is concluded when we dispatch the products and send you the Shipping Confirmation.
The Seller retains ownership of the products until the purchase price is fully paid.
PRICES
The prices of all products are displayed and charged in euros. VAT is included in all prices.
The listed prices are valid for all payment methods.
Delivery costs are not included in the product prices. Delivery costs will be added during the ordering process and will be indicated as a separate item on your order.
For shipments outside the Republic of Croatia, additional costs, such as customs fees or import taxes, may arise, depending on the destination country's regulations. These costs are not included in the product price shown on our web shop. The customer is solely responsible for paying such additional costs. For more information about these costs, we recommend contacting the local customs or tax office before placing an order.
Please be aware that when paying by credit or debit cards, internet banking, or general payment slip, additional costs may arise as a result of the relationship between the customer and the card issuer, credit institution, or payment service provider. The Seller is not responsible for these costs, and the customer is fully obliged to bear them.
The Seller reserves the right to change the prices on the website at any time. The price that is indicated on the website at the time of sending the order will apply unless there is an obvious price error, in which case we reserve the right to refuse to accept any order based on incorrect price information.
PAYMENT OPTIONS
You can pay for your purchase using one of the following methods:
• credit or debit cards (Visa, Mastercard, Maestro, American Express, and Diners), through CorvusPay payment solutions, provided by Corvus Pay d.o.o., Buzinski prilaz 10, Zagreb, OIB: 67770246314
• general payment slip (cro. opća uplatnica) or internet banking
• cash on delivery, available only for products delivered within the Republic of Croatia.
SECURITY OF ONLINE PAYMENTS
While conducting payments on our web shop you are using CorvusPay – an advanced system for secure acceptance of credit cards on the Internet. CorvusPay system ensures complete privacy of your credit card data and personal data from the moment you type them into the CorvusPay payment form. Data required for billing is forwarded encrypted from your web browser to the bank that issued your payment card. Our store never comes into contact with your sensitive payment card data. Similarly, CorvusPay operators cannot access your complete cardholder data. An isolated system core independently transmits and manages sensitive data while at the same time keeping it completely safe.
The form for entering payment data is secured by an SSL transmission cipher of the greatest reliability. All stored data is additionally protected by hi-grade encryption, using hardware devices certified by FIPS 140 2 Level 3 standard. CorvusPay fulfills all of the requirements for safe online payment prescribed by the leading credit card brands, operating in compliance to the PCI DSS Level 1 standard - the highest security standard of the payment card industry. Payments made by cards enroled with the 3-D Secure program are further authenticated by the issuing bank, confirming your identity through the use of a token or a password. All information collected by Corvus Pay is considered a secret and treated accordingly.
The information is used exclusively for the purposes for which they were intended. Your sensitive data is fully secure and it’s privacy is guaranteed by the state of the art safeguard mechanisms. We collect only the data necessary for performing the work in accordance with the demanding prescribed procedures for online payment. Security controls and operating procedures applied within the CorvusPay infrastructure not only ensure current reliability of CorvusPay but permanently maintain and enhance the security levels of protecting your credit card information by maintaining strict access controls, regular security and in-depth system checks for preventing network vulnerabilities.
DELIVERY
Products purchased on our website will be delivered via courier service. When placing your order, please provide all necessary details, such as apartment number, room number, building, and company name if applicable.
If a shipment cannot be delivered due to the customer's absence, it will either be resent at the customer’s expense or canceled.
Delivery times may vary based on the delivery address and the delivery method chosen when placing the order. Delivery generally arrives within 30 days from the moment the Shipping Confirmation is sent.
From the moment of delivery, the customer bears the risk for the purchased products.
Upon receipt of products, the customer is obliged to check for any damages and deficiencies in the delivery and inform the Seller immediately if any are found.
SELLER'S LIABILITY
We strive to ensure that all product details, descriptions, and images on our website are accurate when entered into our system. However, we don’t guarantee that all information, including colors and images, will be accurate or complete, as permitted by applicable law. Images are intended for illustrative purposes only, and actual product packaging may differ.
The website may contain typos or inaccuracies. Therefore, we reserve the right to correct any errors, inaccuracies, or omissions (even after an order has been submitted) and to change or update information at any time without prior notice. Please note that such errors, inaccuracies, or omissions may pertain to product prices and availability, and we reserve the right to cancel or refuse to accept any order based on incorrect pricing or availability information.
La Libellule d.o.o. is responsible for material defects in sold products (e.g., discrepancies in delivered quantities, delivery of damaged products, etc.) in accordance with the provisions of the Croatian Civil Obligations Act (Official Gazette, 35/05, 41/08, 125/11, 78/15, 29/18, 126/21, 114/22, 156/22, 155/23).
UNILATERAL TERMINATION OF THE CONTRACT
In accordance with the provisions of the Croatian Consumer Protection Act (Official Gazette, No. 19/22, 59/23), a customer, who is acting as a consumer, is entitled, without giving reasons, to unilaterally terminate the contract within 14 days from the day the products are handed over to them or to a third person designated by them, other than the carrier.
However, the customer does not have this right in the following cases:
• if the customer unseals the product (takes it out of the package) and it is no longer possible to put it back in the package for hygienic reasons (e.g. if you have opened a perfume or other cosmetic product); or
• if products are made in accordance with the customer's special requirements; or
• if products are customized or personalized (e.g. packaging contains personalized inscription).
To exercise the right to unilaterally terminate the contract, the customer must inform the Seller of their decision to terminate the contract before the expiration of the aforementioned 14-day period. Also, the customer must return the goods to the Seller without delay and no later than 14 days from the date of notifying the Seller of their decision to terminate the contract. The customer bears the costs of returning the products to the Seller. Additionally, the customer will be liable for any decrease in the value of the products that is the result of handling the products, except for that which was necessary to determine the nature, characteristics and functionality of the products.
The customer can notify the Seller of their decision to terminate the contract using the unilateral termination form available on this website or through any other clear statement expressing the intention to unilaterally terminate the contract.
If the customer exercises their right to unilateral termination of the contract, La Libellule d.o.o. will, within 14 days from the date of receiving the returned goods or from the date the customer provides proof of having sent the goods back, refund all payments made under the contract, including the costs of shipping the product from the Seller to the buyer.
La Libellule d.o.o. will make the refund using the same means of payment used by the customer when paying, unless the customer explicitly agrees to another means of payment and under the condition that the customer is not obliged to pay any additional costs for such refund.
PROTECTION OF INTELLECTUAL PROPERTY RIGHTS
The Seller is the holder of the registered trademark. Unauthorized use of this trademark in any form, including, but not limited to, reproduction, distribution, or sale of products bearing the registered trademark, without the Seller’s explicit permission, is strictly forbidden.
Any unauthorized use of the content from the website www.eveilleurparfums.com without written permission will be considered a violation of the copyright and other intellectual property rights of the Seller.
The Seller reserves the right to charge for any unauthorized use of his intellectual property rights at his own discretion, and to pursue legal action for its rights protection and damage compensation without prior warning.
APPLICABLE LAW, JURISDICTION AND DISPUTES RESOLUTION
These Terms and Conditions of Sale are applied and must be interpreted in accordance with the laws of the Republic of Croatia.
The Seller and the customer will endeavor to resolve amicably any disputes arising from the interpretation, validity and/or execution of these Terms and Conditions of Sale or the concluded purchase contract. If they are unable to do so, the competent court in Metković shall have exclusive jurisdiction.
We inform you that the European Commission provides an online platform for resolving consumer disputes, available at the following link: http://ec.europa.eu/consumers/odr/. Consumers can submit their requests via the mentioned online platform for the purpose of resolving legal disputes.
